These Terms of Use ("Terms") govern your use of the Songada app for Mac, iPad, and iPhone (the "App"), provided by Iconic Horizon, Inc. ("Iconic Horizon", "we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. Your use of the App is also subject to Apple's Licensed Application End User License Agreement (the standard Apple EULA). Where these Terms and the Apple EULA conflict, the term more protective of your rights to your own data prevails.
The catalog and any content you create or enter in the App ("Your Content") belong to you. We claim no ownership of Your Content and acquire no rights to it. Your Content is stored on your device and in your private iCloud; see our Privacy Policy for details. You are responsible for keeping your own backups, which the App makes available via export.
The App — including its built-in Learn guides and any descriptions of how the music industry works — is provided for general, educational information only and is not legal, financial, or tax advice. It does not create a professional relationship. For decisions about your specific rights or registrations, consult a qualified professional.
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will meet every requirement. You are responsible for the accuracy of the data you enter.
To the maximum extent permitted by law, Iconic Horizon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or relating to your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law.
We may update the App and these Terms from time to time. When we make material changes to these Terms, we will revise the date above. Continued use of the App after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules.
